The Max Planck Institute for Foreign and International Criminal Law developed out of the Seminar for Foreign and International Criminal Law at Freiburg University, established by Adolf Schönke in 1938. The Institute hosts two research departments that cover criminal law and criminology.

The main research areas of the Department of Criminal Law concern German and foreign criminal law, criminal procedure, the legal basis of criminal justice administration, comparative criminal law, international criminal cooperation (incl. the law of extradition and the law of international mutual assistance) and international criminal law. The Department of Criminology that is a multidisciplinary research team covers the areas of research on delinquency, crime and social control incl. criminal corrections, prison systems, victimology and the systems of criminal sanctions.
